1. Acceptance of Terms and Conditions
By using the app-based car wash membership service (the "Service") provided by Autowash, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Service.
2.1. Registration: To access and use the Service, you must create an account and become a member through the Autowash mobile app. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.1.1. Eligibility: You must be of legal age to enter into a contract and have the legal capacity to use the App.
2.1.2. Restrictions: If you are using the App on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms. This membership is not to be used by businesses to increase personal profit. All businesses should connect with Autowash Fleet Management for information regarding services specific to their needs.
2.1.3. Ride Share: Taxis, limos, app-based transportation services (including but not limited to Uber and Lyft) and other professional transportation vehicles may be limited; Autowash may terminate a Membership upon a violation of these terms and conditions.
2.2. Membership Fee: You agree to pay the membership fee specified at the time of registration. This fee is subject to change, and you will be notified in advance of any changes.
2.3. Plan Types:
2.3.1. Basic Club – includes the bottom level wash (Essential Level or Express Level) car washes at any location. The plan also includes unlimited vacuums at all locations via the mobile app.
2.3.2. The Autowash Classic Membership – includes one (1) vehicle wash per day (Excluding the Incredible wash), every day, including self-serve wash bays. The plan also includes unlimited vacuums and dog washes.
2.3.3. The Autowash Incredible Membership: – includes one (1) vehicle wash per day, any wash level, every day, including self-serve wash bays. The plan also includes unlimited vacuums and dog washes. In addition, this plan includes a complimentary exterior detail kit (subject to availability).
2.3.4. Family Plan – allows members to add 1 (one) additional user to an already existing account in good standing. Family Plan members are subject to the terms of the primary plan, including only one wash per day for the family. Each family user added to the account will have access to the car wash. That means that all members of the family plan share the single ‘free’ wash per day. Once the first member of the family plan uses the daily free wash, the remaining user of the family plan will need to either purchase additional washes to use it on the same day or wait until the following day to use the daily wash. The daily wash clock resets at 12:00am each night.
2.4. Cancellation: You may cancel your membership at any time, subject to the terms specified in the cancellation policy.
2.4.1. Memberships can only be canceled by speaking with a representative via phone, text or email. Cancellations will then be confirmed via email. To cancel your membership call or text (303) 927-9061 or send an email to email@example.com If you are unable to reach a representative by phone, leave a voicemail with your name, membership email, and phone number so the cancellation process can be completed in a timely manner.
2.4.2. Cancellations must be received before the renewal of the next billing date; otherwise, you may be charged for that month and the cancellation will not be effective until the following billing date. Email requests must be received 24 hours before the billing date to guarantee the cancellation is processed in time. The fastest and easiest way to ensure cancelation is to call and speak with a representative.
2.4.3. Deleting, removing the app from your mobile device, changing mobile carriers or phones is NOT considered a cancellation request. Refunds will not be provided for users who simply delete the app and do not follow the cancellation process above.
3. Use of the Service
3.1. Car Wash Access: As a member, you are entitled to use the Service to access car wash facilities provided by [Your Company Name] at the locations specified in the app.
3.2. Usage Limitations: Your membership may be subject to usage limitations, such as the number of washes allowed per month or the types of washes available. These limitations will be outlined in your membership plan.
3.3. Prohibited Activities: You agree not to engage in any of the following activities while using the Service:
Street Racing, Burnouts, or other activities that risks the safety of customers and/or the facility.
Violating any applicable laws or regulations.
Tampering with car wash equipment in any manner.
Engaging in any fraudulent or unauthorized activities.
Harassing, threatening, or harming other members or Autowash’s employees.
4. Payments and Billing
4.1. Payment Information: You must provide valid payment information to Autowash for membership fees. You authorize Autowash to charge your chosen payment method for all applicable fees.
4.2. Billing Cycle: Membership fees will be billed on a recurring basis. As an Autowash App member, you understand that your credit card will automatically charge each month until the Membership is paused, canceled or terminated. Each month you will receive an email reminding you of the monthly membership. Email notification will also be provided if the amount changes, in which case Autowash will provide at least 30-day notice (but no more than 60-day) prior to payment being collected.
4.3. Pricing: The Membership cannot be combined with other offers, discounts, prepaid washes, or gift cards.
4.3.1. Pay-per-wash: The Autowash Pay-Per-Wash feature is not part of the Membership and purchases using this feature are not refundable for Membership or reimbursement. Members that use the Pay-Per-Wash feature acknowledge that they are choosing to purchase additional wash codes, or other services, beyond the 1 wash per day included in the membership and will be charged for each wash they purchase using the card on file.
4.3.2. Discounts and Coupons: Discounts and Coupons have no cash value. Additional member benefits and offers, including free offers, are subject to availability and continued membership good standing. Some discounts may be applicable only to new users. No refunds or credits will be provided for any discounts or coupons.
4.3.3. Referrals and Clean Credits: Referral credits have no cash value and are not redeemable for cash. The Referral promotion is only available in the app. Members who join without using a referral code do not qualify to receive the promotional discount or credit. The Clean Credits and the Referral promotion is only available in the app.
4.3.4. Promotional Pricing: Promotions that indicate a monthly price are deemed to be a dollar amount subtracted from the current membership pricing. For Lifetime discounts, the coupon or discount off the current membership pricing is forever, however the base price is always subject to adjustments as necessary but not without notice. Autowash reserves the right to suspend, pause, or cancel any and all promotion for any reason without notice.
4.4. Refunds: If the membership has been used during the current billing period refunds will not be issued. Membership plans will remain in effect for complete months at a time. No refunds or credits will be given for partial periods or lack of use. Retail washes that complete as intended will not be issued refunds for any reason.
4.5. Late Payments: Failure to pay membership fees may result in the suspension or termination of your membership.
5. Privacy and Data Security
5.2. Duplicate Accounts: Autowash is not responsible for duplicate accounts created by users. We will do our best to discover similar emails, however No refunds will be given for charges resulting from multiple accounts with different email addresses. Any overpayments on a single email account will be credited to that account as a paid-in-advance credit and will not be refunded.
5.3. Security: You are responsible for maintaining the security of your account credentials and ensuring the confidentiality of your account information. The membership app is per user and a user’s 1 mobile device. Sharing login information across multiple devices is prohibited, no more than 1 device per user is permitted. App membership may not be used for Fleet services without express permission from Autowash and must use the Fleet program within the app. Family plan users are required to have their own plan, including login information specific to one (1) mobile device.
6. Changes to Terms and Service
6.1. Change in terms: Autowash reserves the right to change these Terms and the Service at any time, with notice to you. Continued use of the Service after such changes constitutes your acceptance of the modified Terms.
6.2. Cold Weather Shut Downs: Autowash reserves the right to close locations due to inclement weather, holidays, equipment maintenance, unforeseeable natural disasters, governmental requirements, location upgrades, or any other reason to maintain the facilities as a going concern.
6.2. Drought Restrictions: Autowash reserves the right to limit membership usage to 10 washes per month during extreme drought conditions as dictated by the state. Notice will be provided should such limitation be set in place due to drought restrictions. Please respect the environment.
Autowash reserves the right to terminate or suspend your membership and access to the Service at any time for violations of these Terms or for any other reason determined by Autowash.
Autowash reserves the right to modify or cancel this program and all Memberships at any time.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Autowash is not responsible for lack of cell phone coverage or connection limitations that may prevent use on any given day. Refunds or credits will not be provided due to poor cell phone connectivity or other personal device limitations.
9. Limitation of Liability
9.1. General Liability: To the maximum extent permitted by law, Autowash shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use or inability to use the Service.
9.2. Multiple Accounts: Users with a ‘false’ email, alternate email, or misspelled email combined with use of the benefits of the membership, agree to all the terms and conditions of the app whether received or not. You have declined your opportunity to receive receipts and you agree to hold Autowash harmless for any act connected to the use of the app or Autowash facilities.
9.3. Lost Wash Code: Autowash is not responsible for the loss of a daily code due to unforeseen equipment malfunction, user error, other customer user errors, etc.
9.4. VEHICLE ATTACHMENTS AND CAUTIONS: Members are responsible for taking care to observe all caution signs and warnings at all Autowash locations, including but not limited to signage regarding automobile accessories and attachments. Users will be held liable for damage caused to Autowash locations for failure to obey all signage. Failure to comply with site signage may result in immediate cancellation of membership.
Autowash is not responsible or liable for damages, real or implied, from users using the app membership to wash their vehicles beyond the amount paid for the subscription during the month of the incident in question.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the said courts, and you consent to the personal jurisdiction of such courts.
